Can I end the tenancy before the fixed term lease expires?
Yes, however you will still be liable for rent until the lease expiry date, or until a new tenant is found, which ever occurs first. You will also be responsible for all costs associated in re-leasing the premises ie. letting fee, lease preparation fee, advertising and difference in new rental figure if lower than what you are currently paying.
How can the rent be increased?
Rent may be increased after the fixed term period of the agreement has expired. The tenant must be given at least 60 days notice in writing. For rent to increase during a fixed term, the agreement must have an additional term showing the amount of the increase.
Landlord - Why is money withheld on my statement?
Monies can be withheld to cover expenses such as rates and repairs.
What procedures are taken if rent falls into arrears?
Reminders are made to the tenant. Failure to finalise the arrears by the 15th day will result in a Termination Notice being issued for the Non Payment of Rent. Further action via the Consumer, Trader & Tenancy Tribunal can not be made until the day after possession is required on the Termination Notice.
Can the bond money be credited towards rent at the end of the tenancy?
Not without the written prior consent of the landlord/agent.
Who is responsible for the initial telephone line connection, re-connection and all other costs associated with a telephone?
The tenant.
How does a sale effect my lease term?
The sale of a property does not effect your fixed term agreement and it can not be terminated on these grounds. If your lease has expired, then the landlord/agent may terminate your tenancy giving at least 30 days notice in writing once contracts for the sale of premises have been exchanged. However, during the marketing period, you must allow reasonable access to the landlord/agent to show prospective purchasers through the premises.
How much notice am I required to give my agent/landlord if I intend to vacate?
When the fixed term period of the agreement is due to expire, either party can give 14 days written notice to end the tenancy. Once the fixed term period has expired, a tenant is required to give at least 21 days notice in writing and the owner must give at least 60 days notice in writing. In the case where the property is sold and the fixed term period in the lease has expired the owner must give at least 30 days notice in writing from the date of sale (exchange date).
Can I install picture hooks or nails on the walls?
No fixtures or fittings may be installed without the prior written consent of the landlord/agent.
How many copies of keys do we get?
One full set for each name listed as a tenant on the Residential Tenancy Agreement.
When should I be paid up to? (tenant)
Rent should be paid up to date at all times, paying in advance rather than in arrears.
What repairs are considered urgent?
